Definitions
This agreement is between North Devon Wake Park Ltd and you, the customer. The person doing any activities at North Devon Wake Park shall be referred to as “participant(s)”. Anyone under 16 needs a legal guardian to sign this document. The activity means using any of the activities offered by North Devon Wake Park and its facilities.
1. Rules of participation and assumption of risk
1.1 By signing this document and completing any bookings/entering the site/participating in any activities, you agree that you and all participants have read and understood the information in this document, can swim competently in open water, and have a reasonable fitness level. You agree that you do NOT have any medical conditions that may preclude you from undertaking the activities (heart problems, existing injuries, recurring injuries, pregnancy, or anything that will affect your ability to partake). If you have any concerns about your ability to participate due to a medical condition, please consult with your doctor before participating. All participants will inform our staff of any medical conditions you or any of your party may have, and if any medical information changes, you agree to make North Devon Wake Park aware of the condition. You will inform the office staff before entering the water and disclose to the staff taking the session of your medical condition(s). By not doing this, you understand that any injury that may occur is the participant's fault. Any abuse towards any members of our team will not be tolerated, and you will be asked to leave and banned from returning.
1.2 By Signing, you understand that the activities offered are physical and have some risk involved, which may be of a type not encountered during everyday life. While we strive to minimise risks, some inherent risks remain, and you acknowledge and accept these risks by participating. You agree that North Devon Wake Park has done its utmost to reduce these risks, and you must remove all jewellery, glasses, fake nails, and watches before part-taking in an activity.
1.3 By signing, you agree that you will not do anything that may jeopardise your or others' safety and will comply with the instructions given by the North Devon Wake Park staff along with any signage around the North Devon Wake Park site. During the activities, you agree to keep all safety equipment on and will only modify something with a staff member's approval. Without a buoyancy aid, you will not enter the water (unless open-water swimming).
1.4 North Devon Wake Park is not responsible for any loss or damage to participants' personal belongings. Participants are required to use the safety equipment provided by North Devon Wake Park and are responsible for its proper use.
1.5 By signing participants expressly understand and agree that they are participating in activities at North Devon Wake Park at their own risk. Participants release and hold harmless North Devon Wake Park Ltd, its officers, directors, employees, agents, and representatives from any and all claims, demands, losses, liabilities, damages, injuries, costs, and expenses (including reasonable attorneys' fees), arising out of or in connection with their participation, except in cases of gross negligence or willful misconduct by North Devon Wake Park Ltd
1.6 Participants agree to act safely and respectfully at all times, which includes avoiding abusive language, dangerous behaviour, and littering. Before participating in any activity at North Devon Wake Park, you must review the specific rules and safety guidelines for that activity. You agree to follow all posted rules, instructions from staff, and any additional activity-specific requirements. Failure to comply with these rules may result in removal from the activity without a refund.
2. Restrictions
Each activity has specific requirements. Any equipment not listed below but required for an activity will be provided.
General Requirements for All Activities (unless otherwise noted):
Minimum age: 6 years old
Participants must be able to swim 25 metres with a buoyancy aid
Participants under 8 years old require an adult in the water (1 adult per 2 children)
Activity-Specific Requirements:
Aquapark: No additional requirements.
Full Size Cable (Wakeboarding/Kneeboarding):
Slow speed (25km/h): Minimum age 10 (unless approved by an instructor on the S2.0)
Standard speed (30km/h): Minimum age 12 (unless approved by an instructor on the S2.0)
Straight Line Cable (Ringo/Beginner wakeboarding): No additional requirements.
SUPstacle: All participants must wear footwear.
Wibit Kids Course (Jr Aquapark):
Minimum age 4, maximum age 8
All participants must wear footwear.
Open Water Swimming:
Minimum age 12
Must have a brightly coloured swim hat and tow float
Must be able to swim 500m without a buoyancy aid
Sauna & Dip:
Minimum age 16
Participants must bring their own towel to sit on
Note: Any participant who does not meet the requirements for a specific activity will be removed from the activity.
3. Data Privacy
3.1 We collect personal data for booking and safety purposes, and to send you promotional communications if you opt in. This information will not be shared with third parties, and you can unsubscribe from promotional communications at any time.
3.2 Your signature gives the instructor concerned and the North Devon Wake Park staff the right to take emergency action and make related decisions in case such action is considered necessary. This includes taking photos or videos of sessions for promotional material, such as on our website or social media. If you do not wish to be photographed or filmed, please inform us when you arrive on site. Signing this statement does not affect your legal rights or our obligation towards you.
3.3 While North Devon Wake Park will make reasonable efforts to verify the information provided, you are responsible for providing accurate and up-to-date information. False or misleading information, particularly on medical declarations, could result in serious injury or harm. North Devon Wake Park will not be held responsible for any injury or incident resulting from inaccurate or incomplete information provided by you.
3.4 CCTV operates at North Devon Wake Park and is monitored for health and safety, park usage and security purposes.
4. Refund and cancellation policy
4.1 We offer a refund if you cancel the booking more than 7 days before your session, and any less time given will result in no refund. For any cancellations, there will be a £5 cancellation fee charged per person.
4.2 We reserve the right to postpone/cancel sessions due to adverse weather conditions (i.e., High wind, Fog, Lightning). We will always try to give as much notice as possible before we cancel/reschedule a session; however, this can be short notice due to fast-changing weather conditions. For any cancelled session, the booking fee is non-refundable. If this happens, call us; we can rearrange the session free of charge.
5. Wake Park Credit & Vouchers
5.1 Any credit issued by North Devon Wake Park, including but not limited to gift cards, vouchers, prepaid credit or promotional credit, is non-transferable and cannot be redeemed for cash or bank transfer.
5.2 Wake Park credit can only be used for purchases at North Devon Wake Park. Any unused credit will remain on the customer's account and can be used towards future purchases.
By signing, you agree you are NOT under the influence of drugs or alcohol; if you are found under the influence, you will be removed from the water and given no refund.
If any provision of this agreement is held to be invalid or unenforceable, that provision shall be severed from the agreement, and the remaining provisions shall remain in full force and effect.
BY SIGNING THE ABOVE DOCUMENT, I AGREE TO THIS DOCUMENT ALONG WITH OUR RULES. PARTICIPANTS UNDER THE AGE OF 16 MUST HAVE A GUARDIAN SIGN AND TAKE RESPONSIBILITY FOR THEM.
